Child support is the legal obligation of parents to financially support their children after separation or divorce. Child support belongs to the child and cannot be waived by parents.

Child support is governed by the Federal Child Support Guidelines under the Divorce Act (Canada) and the Ontario Child Support Guidelines under the Family Law Act. Support is primarily based on the paying parent’s income and the number of children.

How Child Support Is Calculated
Most cases use the table amount set out in the Guidelines. Courts may also order section 7 special or extraordinary expenses, such as childcare, medical costs, and education expenses.
