What Is Spousal Support?
Spousal support is financial support paid by one spouse to the other after separation or divorce. Its purpose is to address economic disadvantage arising from the relationship or its breakdown and to promote fairness between spouses.
Spousal Support Laws in Ontario
Spousal support is governed by the Divorce Act (Canada), section 15.2, for married spouses, and the Family Law Act (Ontario) for married and unmarried spouses. Courts apply statutory factors and objectives when deciding entitlement, amount, and duration.
How Spousal Support Is Determined
Courts consider factors such as the length of the relationship, roles during the relationship, income, earning capacity, and any childcare responsibilities. The Spousal Support Advisory Guidelines (SSAGs) are commonly used to calculate ranges for amount and duration.
Changing or Enforcing Spousal Support
Spousal support orders or agreements may be varied if there is a material change in circumstances. Support can be enforced through the Family Responsibility Office (FRO) where applicable.
